TERMS OF USE
1. WWW.PARADISEHOTELS.ES RESERVATION SERVICES
The users of www.paradisehotels.es may make the following transactions through the Site:
- On-line reservation of accommodation and/or services.
- Reservation of packages, or combined purchase of hotel accommodation and services for a global price, without distinguishing unit prices.
Reservation Services:
MAR ABIERTO-Reservations will inform the user about the availability of accommodation and/or services, although no reserve will be deemed to be firm until confirmed by MAR ABIERTO by e-mail and paid, in an appropriate case, by the user.
In the event of any mistake in the reservation confirmed by MAR ABIERTO, the user must notify it in writing to MAR ABIERTO.
Reservations.
Through the Reservation Service, the user may reserve and purchase accommodation and/or services, receiving from MAR ABIERTO a confirmation e-mail which will include the confirmation of the user\’s purchase.
Guests will be asked to show their passports when they check in the hotel as well as the children’s ones.
Payment.
On-line payment. The amount of the accommodation and/or services purchased will be automatically charged to the credit card provided by the user.
Cancellation policy.
Bookings may be cancelled either by phone, through the number for information and bookings available at the Web, or on-line.
You may cancel your prepaid booking subject to a cancellation fee, as follows:
- The same day the booking was made, from 18:00 hours, 15 €
- 7 days prior to arrival, 1 night*
- 3 days prior to arrival, 2 nights*
- On the day of arrival/no-shows, 50% of the stay / minimum 2 nights
*A price average for each day will be applied.
2. INTELLECTUAL PROPERTY.
All the web contents, as well as brand names, logos, trademarks and bases are subject to intellectual and industrial property rights of MAR ABIERTO or of third parties. The access will never imply the waiver, transfer or assignment, either partly or in full, of the above-mentioned rights, or will confer any right whatsoever of use, operation, reproduction, distribution or public communication over the contents or goods subject to intellectual or industrial property rights without the prior and express authorization specifically granted for that purpose by MAR ABIERTO or the third party holding these rights.
3. PROCEDURE IN CASE OF ANY UNLAWFUL ACTIVITIES.
If any user or third party considers that there are facts or circumstances of an unlawful nature, he/she must send a notice to MAR ABIERTO, containing at least:
- the claimant\’s particulars: name, address, telephone number and e-mail;
- statement of the allegedly unlawful activity carried out at the Site;
- facts or circumstances denoting the unlawful nature of this activity;
- in the case of a violation of rights, the handwritten signature or its equivalent, together with the particulars of the holder of the rights allegedly violated or of the person authorized to act on his/her name;
- claimant’s statement that the information provided in the notification is accurate and of the unlawful nature of the facts or circumstances reported.

4. NOTIFICATIONS.
All notifications and communications (hereinafter, the «Notifications») to be made by the User to MAR ABIERTO, will be deemed to be effective when addressed to the Customer Service by:

- E-mail to: contacto@paradisehotels.es.
All the notifications of MAR ABIERTO to the User shall be deemed effective, to all purposes, when made by:
- Letter sent by mail to the address of the User, when this has been previously notified to MAR ABIERTO.
- E-mail to any mailbox communicated by the User.
- Phone call or data transmission to the User’s telephone/fax number or by sms when these numbers have been previously informed to MAR ABIERTO.
All notifications made by MAR ABIERTO to the User shall be deemed to have been validly made if these have been made using the data and through the means mentioned above. The User declares that all the data provided are true and accurate and undertakes to notify any change in these.
5. REMOVAL AND SUSPENSION OF CONTENTS OR SERVICES.
MAR ABIERTO may remove or suspend, at any moment and without prior notice, the access to the contents or the on-line provision of services to users who are in breach of the provisions of the Legal Notice or of any of its terms and conditions, and reserves the right to exercise the opportune legal or judicial actions.
6. DURATION AND TERMINATION.
The provision of the services or the access to the contents available at the Site has, in principle, an indefinite duration. Notwithstanding, MAR ABIERTO will be entitled to terminate or suspend at any time the provision of services or the carrying out of transactions through the Site, subject to regulations applicable. Whenever reasonably feasible, MAR ABIERTO will inform previously of the above-mentioned circumstances.

8. GOVERNING REGULATIONS AND APPLICABLE JURISDICTION.
This Legal Notice shall be governed by the applicable Spanish law. In the event of any conflict or dispute in relation to or arising from the construction and/or performance of this Legal Notice or of any other of the terms and conditions contained in the Site, the parties expressly waive any personal jurisdiction to which they may be entitled and submit to the jurisdiction of the competent Spanish Courts and Tribunals with venue at San Bartolomé de Tirajana, Gran Canaria, Spain.
