Taurito, Post code: 35138, Mogán, Gran Canaria, directed to all those visitors of the Hotels belonging or under management of MAR ABIERTO S.L. that wish to participate in it by the fulfilment of the relevant participation coupon. FIRST.- OBJECT OF THE PROMOTION. With the present bases, MAR ABIERTO S.L. sets off a promotion with the aim of giving a prize to the visitors (over 18 years old) of the Hotels belonging or under management of MAR ABIERTO S.L. that wish to participate in it by the fulfilment of the relevant participation coupon, in which questions about your stay in them will have to be answered and excluding the Hotel workers and their direct family. For this purpose, MAR ABIERTO, S.L. will have a prize draw for a weekend for two people in one of the hotels of Paradise Resorts with two relax massages in their SPA KRABÍ. We inform the possible participants that joining this promotion involves the total acceptation of the present Bases. For this purpose, the Bases of the present promotion will be published in the website of the hotels chain belonging to MAR ABIERTO, S.L. which is www.paradisehotels.es and they will be at anyone�s who wants to consul them disposal, being part of this promotion all the instructions published on this website. This promotion is regulated by the current legislation of Spain. Given the necessary premises to the acquisition of participant�s condition in the present promotion, that is, being a visitor over 18 years old of the Hotel/s belonging to MAR ABIERTO S.L., the territorial field is not disposed are limitative, setting as the only condition being a visitor of the hotel mentioned, independently from the buyer�s origin. Not with standing the afore mentioned and with identical logical motivation, it is restricted the application field of this promotion to the island of Gran Canaria ubication, where the mentioned hotels are settled, for the effects of the prize-giving, which will be conformed according to what it is disposed on the 8th Base. MAR ABIERTO, S.L. reserves the right to suspend, postpone, cancel or modify the duration of the promotion at any moment before its end date, always with existing causes that justified them this way. FOURTH.- DESCRIPTION OF THE PRIZE The principal and only prize consists of a weekend for two people in one of the Hotels of Paradise Resorts with two relax massages in their SPA KRABÍ. MAR ABIERTO, S.L. reserves the right to modify the prize for another of the same or superior promotional value if it is considered necessary (for instance, in the case of full occupation or reservation) compromising, in all cases, to communicate the modification to the participants and its publication on the website www.paradisehotels.es. The prize object to promotion is nominative, personal and not transferable, so it cannot be object of change, alteration nor economic compensation or of any other case under petition of the winner in any case. The prize is not changeable for money, not given to a third person either. MAR ABIERTO, S.L. is not responsible for possible loss, deterioration, robbery, delay or any other circumstance imputable to third people that can affect to the prize. FIFTH.- PROMOTION WORKING. 5.1. Participation in the Promotion. Every person that visits the Hotel/s belonging or under management of MAR ABIERTO S.L. over 18 years old that wish to participate, can join the promotion by the fulfilment of the correspondent participation coupon, in which there are questions about the stay in them, having to answer them and excluding the Hotel employees and their direct family. The visitor condition on age of each of the Hotels belonging or under management of MAR ABIERTO S.L. will mean the automatic right to be able to participate on this promotion, but not the automatic participation on it. The admission as visitor participants will demand the acceptation and fulfilment by them of all the participation coupon�s data specifically habilitated to this effect, and its answers of its disposed questions. In order to spread the present promotion, at the receptions of the Hotels there will be advertising information about it, and also on the website www.paradisehotels.es. Visitors that wish to participate in the draw should apply for and obtain at the receptions of the Hotel/s of MAR ABIERTO S.L. the participation coupon specifically habilitated for this draw, having to proceed to fulfil it in its totality and proceeding to its delivery at the MAR ABIERTO S.L. facilities themselves. Only the fulfilment and delivery of this participation coupon to the MAR ABIERTO S.L. staff will consider the visitor as a participant of the promotion in all its effects. At the moment of the fulfilment of the participation coupon, its owner should present his/her ID or the correspondent supporting document, checking the stay on the facilities by the Reception staff of the Hotel. MAR ABIERTO S.L. reserves the right to cancel and expulse automatically any participant that is estimated to do a bad use or abuse of the promotion, with the correspondent cancellation of his/her participation. It is understood as a bad use the not fulfilment of any participation condition included in this bases. 5.2. Celebration of the draw. MAR ABIERTO will collect the participation coupons in locked boxes, proceeding in the date of the celebration of the draw to break its closing system and to empty it putting all the coupons on a table in the Saloon Conference of the Hotel Paradise Valle Taurito by a live draw that anyone can attend to. By means of an impartial person, we will proceed to take two coupons from the mentioned boxes, the first one will be the winner and the second will be the substitute/reserve. The substitute number will be taken in the case that the prize winner cannot be located in five days after the date of the live draw, the winner does not have the established requirements in the present bases, rejects the prize or that any of the circumstances collected in the present bases for the happening of this supposition. In the case that the coupon/token kept by the guest is unintelligible, the procedure is to declare it null and void and to take another coupon from the box. SIXTH.- DATE OF THE DRAW The date of the live draw will be on 4th May 2010, between all the participants of the promotion, in the terms explained in the present Bases. MAR ABIERTO reserves the right to modify the date of the live draw only under justified causes, in this case, MAR ABIERTO will communicate this circumstance by its publication in its website(www.paradisehotels.es.). SEVENTH.- ANNOUNCEMENT OF THE WINNER The announcement of the draw�s result to the winner will be after the draw via e-mail with delivery report to the e-mail indicated by the participant in his/her coupon, and also it will be published on the website www.paradisehotels.es. In the case of not being able to contact the winner in the established period, that is, 5 days from the date of the live draw, the prize will be for the substitute / reserve person. The winner, or in the case the substitute/reserve person, will have to confirm the acceptation or not of the prize maximum, three (3) working days after MAR ABIERTO S.L. has notified his/her condition of winner. The participation in this promotion means the authorisation of use to MAR ABIERTO S.L. of name and surnames or in the case, the image of the winner, as well as its publication in www.paradisehotels.es. EIGHT.- PRESENTATION OF THE PRIZE. Once known the name of the winner and the acceptance of the prize, MAR ABIERTO will put at his/her disposal the prize of a stay in one of the hotels, for its use in the period of 2010, deepens the availability, having to notify MAR ABIERTO, S.L. with a previous announcement of at least 20 days, date that the winner chooses for its use, for the purpose that its viability can be checked. In the case the winner does not use his/her stay given as a prize by MAR ABIERTO S.L. in the mentioned period, it will be considered as a renunciation to it, with no possibility of claim. The participants and winner�s identity will be checked by presented the official documents (ID, passport or other identification document) NINTH.- PRIZE INCOME TAX REGULATION. The prizes are subjected to deduction or deposit (according to the article 75.2 c) of the �Real Decreto 439/2007, 30th March, by which the Regulation of the Income Taxes is approved) In accordance to what it is stated on the article 105.1 of the aforementioned �Real Decreto�, the quantity of the deposit will be calculating applying the 18% of the result of increasing in a 20% the value of acquisition or cost for the payer. The deposit of this deduction in the Spanish Tax Agency will be done by MAR ABIERTO S.L. The winners will have to declare this prize on their income statement according to the tax year in which it is received, as a patrimony profit, including in its taxable base, the value of the prize obtained (market value), in addition to the deposit, unless the deposit had been assigned to the prize winner, in which case only the market value will be given. For this purpose, MAR ABIERTO will send the appropriate certificate. The payment of the �Impuesto General Indirecto Canario (IGIC) will be deducted to MAR ABIERTO. On the contrarym, the rest of taxes such as date of registration, traffic taxes and the �impuesto municipal sobre vehículos de tracción mecánica� will be deducted to the winner. TENTH.- PERSONAL DETAILS. All the participants of this promotion should fill the participation coupon up in its totality with truthful details. In the case that these personal details were false and it is the winner�s coupon of the present promotion, this prize will be given to the substitute / reserve person. The information given by the participants of the present promotion is done voluntarily.
